I need help with a sentencing letter to a judge regarding my neighbor.?
I have had to press charges against him in the past for threatening, menacing, & assault against me & my family. I am a firefighter & I fear for my family’s safety when I am not home. My neighbor of 10 years & he is about to be sentenced in another case of felonious assault in a couple of weeks. I don't want this horrible bully, alcoholic, & terror of a man slip through the system again just because he is in his early 70's & plays the "frail-old man card"...he is NOT that. He has already plead guilty to a felony 2 but it is possible he may not do jail time. He has a terrible reputation but people are not’t aware that character references from people in his community can affect the judge’s decision. I am having trouble finding a “template” or sample sentencing letter to the judge other than ones that are character references as to their “good” character & about sentencing reduction. I & another neighbor want the judge to know this man is a danger to society & nightmare to live near. If you have any suggestions, all are greatly appreciated. Thank you

- Just be truthful - tell the judge the story how how terrified people are of him and how they live in fear of him, and how this alters their day to day lives
- Save your time and effort the judge can not legally read correspondence regarding a case past or present You need to talk to the prosecutor
- Mozzie is write but in regard to knowing how a judge ticks, it should be a decent length. They usually disregard letters of less then 5 paragraphs due to "lack of quality and reliable information". You are also going to follow a good sentence structure. May I recommend a OREO Format Opening: (Hi my name is _____ And this is my problem ______) R: Reason E: Example and or proof 1 R: Reason 2 E: Example and or proof 2 R: Reason 3 E: Example 3 Opening Restated: (So thank you for your time... please take this into consideration...contact me at ___, etc.) Each paragraph should have 5 sentences. So Opening is 5. RE's are 5. And Opening Restated is 5. Good luck
- Judges do not decide sentences (or anything else) based on secret communications recieved through the mail. The decide sentences based on actual testimony, presented in open court and tested by cross-examination. If you think you have something relevant that the prosecutor might want to present at sentencing, then contact the prosecutor and let him/her know about it. Perhaps he/she will call you as a witness at the sentencing hearing.
