1. When using free templates, understand what the developer requests rather it be citation of his workmanship located in credits or a possible link back to his page. This should all be located in agreements(EULA) etc., ensure that you aren't stealing the work if you change any of the code.
2. It isn't to do with the flash templates but to do with the conditions they came with. If they are "free" I guess it means you can use them.
